I’ve gone back and forth several times in my mind as to what the amount will be...

On one hand, maybe DM settled for whatever Samsung finally offered so they could make easy money without having to go to Markman - so the amount was probably small like the others ($2-3M).

On the other hand, maybe Samsung offered to settle early like the others but DM held them to a higher standard due to their greater and possibly willful infringement - so the amount should be significantly larger ($5M+).

Without knowing I could argue either side. The timing of the SHM does seem like it should be an indicator but it certainly doesn’t have to be. It really depends on DM’s philosophy and strategy.

What is most interesting to me (and what the market has totally failed to appreciate thus far) is DM’s obvious change in tactics by using ONLY the ‘774 patent and thus sharpening their attack. It seems clear that their intent is to settle these cases as quickly as possible.

I’m guessing we’ll see a PR on the 10Q along with webcast info after close today or before open tomorrow.
