I think it makes sense for DM to push Samsung to Markman AND to initiate more filings well prior to Feb. 2010. That way those companies could all watch with interest as the Samsung case approaches Markman. Some would likely settle before Markman and some would wait... but why not have them on the hook one way or the other?
