LL, let's assume we win at trial and digEcor decides to appeal. Let's further assume that we win the appeal due to the Court's "extensive homework in citing caselaw and analysis of the various documents" in all its rulings to this point. How does the appeal process work? Does the Court of Appeals simply review the Court's rulings and decide whether proper law was applied? Are there oral arguments heard or is it just a paper review? Seems the process would be quick, 60 - 90 days, from start to finish.
Should we win the trial and potential appeal, I sure hope the Court of Appeals would be inclined to award EDIG attorneys' fees and court costs, at a minimum, for appellate costs incurred. As you've stated, BOW seems on a personal mission to get EDIG for imagined wrongdoing when so far, the Court has disagreed with most of his allegations.
