I concurr with everything you say...

More than any other type of law suit, IP litigation has its the usual 3 stages...

1) The "Filing of the Law suit", making "Claims" that pass the test of Motions for Summary Judgment;...

2) The "Validation of the Claims" by "Settlements"with some of the defendants which affirms the "Liability" issue as seen by the "community at large"; and

3) A "Judgment" by a judge, (i.e. a MARKMAN RULING", or by a jury after trial, which affirm the plaintiff's claims...

After that it is only a question of "How Much" the defendants should be paying to EDIG...

EDIG is in phase (2) now, and if VIVITAR'S recent Motion is granted, we shall know which one of the orifinal 8 defendants named thus far shall be at the Markman Hearing set for 2009...

It is quite reasonable that the time frame is within the next 120 days, and I bet we will see a marked in the number of settlements prior to the Markman Hearing date...
