“The case did not resolve at this time despite significant efforts of all participants.”

The language in this document was entered by either a court clerk or Judge Nuffer himself, not by the Parties. I’m hopeful the wording “at this time” implies both Parties are still interested in working towards a settlement. It seems possible given that the next day EDIG withdrew 4 counterclaims. The wording, "significant efforts of all participants", tells me that EDIG & digEcor want this to be settled.

If we see digEcor make some concessions soon, then I believe the chances are at least 50/50 this will go away before trial.
