I`m not a lawyer, but a former contracts manager, so I`ll give it a shot. Assuming there is an exclusivity clause in any standing contractual vehicle (MOA, formal contract, napkin), if Wencor defaulted, it would be up to the courts (unless remedies are specified by contract, which is unlikely) and would be likely based on damages incurred (though another aspect would be Wencor`s damaged reputation - kinda hard to get any new/used business relationships if it`s known you can`t be trusted). If there are patent infringement issues, upon Wencor`s sale of an infringing product, we could go after `em down that (more fruitful) path. I seriously doubt (as I believe do you) that we have to worry about it....
