Again questions>>>>DXG must answer the subpoena or go to a judge and seek to quash it......That's legal....right....judge involved....which means the final say as to weather the subpoena is honored is in a JUDGES HANDS IN A COURTROOM.....If he says DXG must comply he has to have a legal reason to do so. That legal reason MUST be presented by DM to the judge and must constiture evidence, factual evidence that DXG is involved.
So again I ask my dumb question. When all this plays out and DXG must comply with the subpoena, with evidence presented as to their complicity with Vivitar, does not that make DXG a de facto IP infringer itself?????
And if DXG complies with the subpoena and presents all the documents, etc....requested by DM aren't they incriminating themselves????
Or can they refuse to comply under the 5th amendment???
