To me it was an obvious route to take.

If you lost to the little guy, the chance of success on the high hanging fruit would be almost zero.

If you ultimately achieved a settlement against a Samsung, Intel, HP, etc., then the small low hanging fruit would follow along peacefully.

An appropriate course regardless of recent rulings.
