Specifically the 8-K document dated March 23 stated ................

"The first target is contemplated at this time to be ***. The scope of this engagement specifically includes the filing of litigation, if necessary, against any other third party infringer. Before agreeing to represent e.Digital in connection with any litigation, Duane Morris reserves the right to review each case on its own merits to make a determination of the merits of the case, and resolve any conflict issues."

I don't see where they have chosen anyone at that point in time, its a matter of  the contract wording. They just entered into the agreement, not a lot of time to make a determination as to the merits of any individual case.

Now, I do hope they are close to making an announcement, a lawsuit or a  settlement under negotiation.
