Hi Hans, Sure in the end the size might have some relevance but it is not clear whether that is a positive or negative at this point. Your argument seems to be that if Tyhee loses this case it will not survive, or survive in a much lesser form, because it is too small to live through adversity like this. Seems unlikely. The other side of the size argument is extracting money out of someone who cannot pay it and destroying an entity (actually two entities in this case) that otherwise would be viable and add to the economy at many levels while also violating the corporate code of governance may turn the court towards dismissing the charges. I think this is a much better argument but who knows what is going on behind the screen? Your other point about DW and his court case, you have to know the reasons why they delayed financing. If Dave was going for assets, you would not want too many of them around when you settled. In this case, the court will decide based on status and conditions at the time the deal was established. I don't think they are comparable. And the key is the price of gold imo. Ike
