If there is no movement by Wyloo or BHP before the close of business on November 9th, is the BOD or BHP required to announce the results (i.e. 51% tendered or NOT) on November 10th?

Presumably there will be an announcement of some sort if/when they do reach 51%, but are they required to announce a failure to reach 51%? If so, when?
