From TPL Opening Disclosure Statement 12-23-13 found in BaNosser post as follows:

The ITC assigned attorney Whitney to represent the ITC in the investigation, and although TPL, et. al, moved that attorney Whitney be excused due to the conflict of having represented in private practice other accused MMP infringers, that request was denied

On Sept. 12, 2013 I sent an e-mail to Otteson asking if there was a conflict of interest as follows: (I never received a reply)

Is there a conflict of interest in having the following Commission staff members ruling on respondents Barnes & Nobles and Samsung?

Jeffrey Hsu, Acting Director recommended no infringement by Barnes & Nobles against Microsoft

http://www.slashgear.com/itc-staff-favors-barnes-noble-in-patent-dispute-with-microsoft-06212288/

David O Lloyd was formerly an Associate of Friedman Wittenstein

http://www.linkedin.com/pub/david-lloyd/12/b78/420

Partner Stuart Friedman's varied litigation experience includes a patent infringement and damages bench trial that extended over a year and a half and resulted in a favorable award of over $200 million

....The clients Mr. Friedman has represented include well-known corporations and entities such as ....Samsung

On Sept. 26 I posted this on agora
