Thanks. Whiel I hope I'm wrong, I believe it has something to do with the 45 day calendar actually being 60 days, as I've posted. The ITC rules on 337 investigations say that for an ID on issues of Violation, the deadline is 60 days.

As explicitly stated in the ID,

"On this date, the undersigned issued an Initial Determination on Violation of Section 337and Recommended Determination on Remedy and Bond in the above-referenced Investigation."

our ID was on issues of Violation, in my opinion. Per ITC rules:

(d) Grant or denial of review. (1) The Commission shall decide whether to grant, in whole or in part, a petition for review of an initial determination filed pursuant to § 210.42(a)(1) within 60 days of the service of the initial determination on the parties, or by such other time as the Commission may order.

And per referenced ITC rule 210.42(a)(1),

§ 210.42 Initial determinations.

(a)(1)(i) On issues concerning violation of section 337. Unless otherwise ordered by the Commission, the administrative law judge shall certify the record to the Commission and shall file an initial determination on whether there is a violation of section 337 of the Tariff Act of 1930 in an original investigation no later than 4 months before the target date set pursuant to § 210.51(a)(1).

I guess time will tell. Seems like PTSC should be able to answer this question pretty easily, though they continue to refused to.
