they already know what we have on them, it's just a matter of showing what we know and have already argued/shown to the Judge, to a Jury.

As for Acer's laptop products, in addition it the damages limitation as a result of the Intervening Rights ruling, I'm under the impression that many of their infringment containing products are out of production; thus even further limiting their exposure. Frankly, I expected Acer would settle, and told a few folks that as well.

As far as Amazon.... why settle a $50M damages claim when you have the NDOC on the verge of a ruling which could open the gates of leverage to the Court House for recovery ?

Unfortunately, I believe You're right, Amazon was likely for relatively small dollars in an attempt to sweep some cash into our account. My problem with this settlement is that we are sending a message of accomodation and cooperation too early, just as we were/are acquiring a big stick and supposedly setting the stage to finally arrive at a finding of infringment; and all the negotiation/fear benefits that such a legal Finding can offer us against the industry.
