Thus, a general exclusion bars entry of goods of persons and entities that were not parties to the investigation. A general exclusion order even bars products of entities who could not have been named as respondents in the investigation, such as companies that decide to embark on manufacture or importation only after an investigation has been concluded and an order issued. Because general exclusion orders reach merchandise beyond that which was adjudicated in the investigation, there is a greater potential for collateral effects on legitimate trade. Consequently, the statute and the ITC’s longstanding practice require a higher threshold of proof to be satisfied in order to obtain a general exclusion order.
