At approximately the same time, Markman ruling came out, the USPTO granted the re-exams and that process began, so it's difficult to say what had the greatest influence on the licensing program, but it clearly appears as though the previous Markman ruling may have not been as favorable has has been spun by TPL, based on their subsequent ability to collect licensing fees
The re-exams and perhaps TPLs own patent portfolio. The licenses didn't increase in frequency or value with the revalidations of the MMP so one would assume it is something else.
