Think of it this way...attorneys file orders for the judge to sign. If you didn't know better, one might read the order and assume it is so. Perhaps PTSC attorneys submit the dismissal in anticipation of the judge signing if TPL misses their deadline.

Just a weak attempt at an analogy perhaps but it makes sense to me.
