Couldn't it also be argued that PTSC went the amicable route with TPL to obtain a settlement, TPL dragged it out, possibly hoping that PTSC would do nothing of substance. TPL was wrong, their bluff was called and now the pressure is back on them to come up with something pretty quickly if they don't want everything aired in court?
It all boils down to probability.
TPL, as the alleged offenders, will know exactly what they have, or have not done, and as lawyers will be more aware than most of the probability of a successful defence to the allegations. Once that is .3 or below it would be extremely foolish to continue with the uncertainty of what may be awarded at court should they lose.
They are either "saints" or "sinners", and if the latter, PTSC are holding all the cards.
