Are you referring to the 2 month deadline for TPL to waive the right (or not) to respond to the re-ex that was determined to be ordered?

I doubt they will respond and give the requestor a chance to submit further details. I expect an OA terminating the reex shortly after, IMHO.

FWIW....our response to the non-final OA of the '890 (app.#90/009,388) was received exactly on the 2 month deadline (01-05-2010) but is not yet available for viewing in the IFW.

Our response to the non-final OA of the merged '749 reex (app. #90/009,034) is due by Jan. 19th.
