I agree with the above but not sure how it applies to the question. It was at least part of the 4/5/07 OA rejection. It had to have been argued by our side. I do not see an argument in response to the 4/5/07 OA rejection.

Just want to be sure I am not overlooking it somewhere in all the merged reexams before I ask the PTO to post it.
