Making sure I've got the situation straight....

Per my understanding, we're waiting for a PTO (or other authority) response to our appeal of the PTO's final decision that the '336 is invalid due to prior art. Meanwhile, two additional requests for re-exam were submitted to the PTO, and now one of those requests has been denied. Have I got the situation straight?
