Personally I missed that information somehow..I assume it's in the T-3 filing somewhere or somewhere else that I failed to read/notice.

As far as licensing amounts are going I think what we're seeing is the lower tier people signing..and aveage of about 1.4 Mm on thel ast two,,,it's cheaper for that amount to pay forl icensing than to litigate which can run into 1-2 Million dollars.

If there are some big-guys out there....in the range you mentioned, they will almost lalays fight it...they usually have an "in house" legal staff they're paying anyway so for them, it pays to litgate and/or wait it out for any ruling from anyplace that may help their cause in negotiations.

And once there is a reexam re-cert, if we jack it up even more then usually they'll pay to 'absorb" that 1-2 million in legal costs to litgate it hoping they can either convince a jury that they don't infringe (which is usually quite complicated for most to understand esp. if they're not familiar with the technical side of things) or at least try to get them to award a lesser fee than we're asking for.

The patent holder knows this too, that's why, in the vast majority of cases, there is some settlement right before the jury selection starts to keep it out of the public domain and not expose the patent holder to a sometimes tight-fisted jury for monetary awards.

When these reexams do come back...and I beleive they will be in our favor for the most part, we may see some of the bigger players still opt to litigate but it will be more of a ploy to use for lessening the asking price from us.

In any case, I hope to see some action heat up regarding the MMP in the next two to three months.
