how many would prefer to settle before re-examination is completed?

The reason I ask is linked to Intel's 90% drop in profits for Q4. Settlement subsequent to revalidation will obviously be at a higher license fee, and consequently a greater percentage of any profits.

How does the FD of a Company put on notice balance current licensees, USPTO arguments and the reverse-engineered evidence of potential infringement against the possible outcome of the USPTO decision while fulfilling their fiduciary duty?
