There's no set time limit for the examiner to respond back to our reply on the non final action...we in turn, had 2 mos to respond to his non final action...unless we asked for an extension of time that is...

I've seen the final responses come as quickly as 30 days and as long as 9-12 mos...and even had more correspondence go back and forth with the examiner if vital questions arose in our response to him on the non final action..

But allow me to qualify my statement with that fact that the ones I have been exposed to in the past were... NOT.... based on obviousness,....they were based on prior art....so my past experience may not hold much weight when dealing with an ..obviousness...claim for rejection....it wouldn't surprise me to see these take longer than the norm, just due to the fact that they seem more subjective in nature...JMHO.
