It has been brought to my attn that Judge Vogels decision DOES decide venue by default. Sorry for the waffling. That's what I get for just dropping in and trying to give my 2 cents worth.

I am wondering if there is still a chance that TPL could move that CFP and MMP be separated and then re-request the venue change for the MMP portion. That would make more sense. Anybody?
