The patents are valid but without USPTO OK, they could justify their courtcase stating that the patents are under review and have a godd chance to be invalidated, therefore, we will not pat until the USPTO says they are OK. TPL believed that the jury might overturn and was not willing to take the risk when they strongly believed that USPTO would find the patents valid. I believe the patents are valid, obviously, or I would have sold every share I own. Themoney will come when the patents are validated.
This is the reason Mr. West, Dutton Assoc. has made such a significant issue in their report several times on the validity of the patents and the USPTO review. Everything hinges on the USPTO from the MMP perspective, that is why it is so critical to acquire something else to change the discussion to something other than MMP validation.
