The latest revenues for NEC America were in excess of $1.6bn for the last 6 months, the other Defendants had multi-billion dollar revenues. To hope for a settlement in the $100m - $150m range, to include damages for past infringement, a MMP Portfolio license, and future royalty would appear a little on the conservative side, in my humble opinion. More so, if there is also to be a message of patent validity to potential infringers to encourage settlement.

There is also the professional status of Roger L Cook to consider, as lead attorney. One has to think of his reputation as litigator, if nothing else.
