Isn't it possible the CM/ECF documents were not released to PACER and is it not possible that the defendants see an appeal as a waste of time since this is now the second Federal Court district to rule on the ACP?
What if it were the Plaintiffs that needed to Appeal? CM/ECF documents should be released unless sealed, if sealed, it should so state on a Pacer.
And regarding that 30 day stay that we see on PACER. I have a lot of trouble seeing Judge Ward approving that stay based on what we see in the PACER document.
So I'm inclined to think the "meat" of the stay (the reason) is in some other document not available to PACER.
Surely Judge Ward would not stay this case for 30 days based on what we have seen. I would be inclined to see him go through the roof if he was asked for a 30 day "hiatus" with no other reasons than we both agree this should be done.
Agreed, no reasons have been given(not even sealed), which is highly unusual. However, until such time as more details are available, ALL is mere speculation.
