I should have included in my answer.. IF it is indeed the potential licensees who are waiting to see an outcome, and not TPL licensing the minimum, inorder to maximize MMP licensing post resolution.. KSR/Obviousness is a new bullet in the defendents shirt pocket that they did not poccess last yr..
