If the case goes to a jury, I'm not concerned about a jury verdict on the 336 and 148. I don't think TPL is either. And keep in mind, if this is won on SJ or goes to a jury, the 584 is not involved in any way shape or form. The only way the 584 only comes into play is if there is a settlement. If it costs the Js roughly the same amount of money for getting relief on the 336/148/584 as it does for 336/148 alone, might the Js consider a statement to be made public that a separate license was obtained for the 584? Sure would be tempting. But the Js would risk The Rath of ARM. At this point offering an MMP license (all 3) would take ARM off the hook, and do nothing to bolster the 584 MH term appellate review. So why would they do it? The reason you gave about potential licensees picking and choosing is hardly a reasonable consideration since it is not up to the potential licesee to dictate terms. Opty
