Does it make sense to assume that had there been an impasse at the conclusion of mediation, a report would have been filed and we would now be looking ahead to the trial.

Therefore, absent an impasse could mean they have issues (i.e. Shaw and Hamilton) that must be resolved by Judge Ward....if they lose on this, then wouldn't it seem that a settlement would be next?
