Thanks opty. My bad from the commo standpoint.

Concern is not a bad or negative thing. For example a baseball player might be concerned about their batting average even though they were batting .385. However, a better choice of words on my part, would have been areas of focus.

Acquisition. This should be done as soon as possible IMHO because this is a buyers market. It would be advantageous for the company to have a guaranteed revenue stream, rather than one dependent on trial outcome. Foe example, if TPL lost they already have much to fall back on and would transition to other areas of patent litigation for example.

Arch Conference.  Will this be a spring board for the company? I have complete faith in Jim Turley and his skills of corporate presentation but will their be institutional/mutual fund interest in this presentation, no matter how well done?

End of Warrants. Certainly a superior event but will it provide a real impetus to gains in the SP? I am hopeful that it will and logic would indicate that it should( NLT Tuesday, October 2nd ).

Mediation. The date is one of my concern. I believe it is at the end of Sept or end of Oct?? This is the area where settlement should occur? Right?   I don't know, not a lawyer,  but it is definitely an area for TPL focus and ours.

Quarterly Report. We won't know the results for some time. This is where we will find out if licenses have been signed. The way Jim handles these during his interviews tells us that this is an area that is taboo for open discussion at the present time or otherwise he would go into great detail if it wasn't (IMHO). There may be numerous reasons that the lawyers are aware of that I'm not that would cause them to delay signings, delay press releases, etc. It is an unknown area at present. It seems to me that Judge Ward insisted that actions of the past and maybe the present and future were things he didn't want to hear about or know about as his decision will be based only on the facts presented and no outside PR or other influence would effect his decision. He seemed to be irritated when the subject came up in the Markman. Strategically, TPL is complying with Judge Wards request. This is all total conjecture on my part but it seems logical.

USPTO Decision. This has great importance. This is a must win. Dutton would immediately chane from .75 to 1.50 immediately. The SP would skyrocket. IMHO it is just as important as the trial!

I can be challenged in each of these areas and appreciate the dialogue. This is my best guess. Mediation and USPTO probably do not occur in September but these dates keep on changing and I get cornfused.

Regards, Oscar
