Further re highly technical phrase. If we can assume this has no negative connotation, then I suspect that it is just providing a reason why summary judgement may not be requested immediately. They need to state their case why summary judgement is proper and it they need to work with what the court gave them, which is not exactly what they were working with before. Just a guess. Opty
