Also, most lawyers will tell you that judges (as in Ward with the Markman or appellate justices in general) are generally NOT swayed by oral arguments. It is the written briefs that decide these types of cases. The oral arguments are used by judges to firm up their own opinion, solidify something, etc. Only rarely do oral arguments flip or convince a judge one way or the other.
That is another way of saying Judge Ward almost certainly already knew how he was leanging/deciding before today's hearing.
