First let me say I don't have the legal expertise Ron seems to have, and I greatly appreciate his insight into things. What I do have and can comment on, is the experience of sitting through a couple of Markmans.
When Ron says...NOTHING REMARKABLE"....to me and by my last sit through of a Markman....this is GREAT NEWS FOR PTSC.
When the patent holder has nothing consequential occur during the Markman and the quickness of this one also, it shows me that any patent claim that might have been the basis of the defendants case has been put to bed in our favor.
Now when the judge posts his findings on Pacer, then the "winner' of this hearing usually asks for a summary judgement in their favor...of course that doesn't include the mediation process that might be directed at both parties.....that is the part that usually takes the 30-60 days...the judges final answer to the summary judgement requested by the side that filed for it...in this case...the winner of the Markman.
Now, when Ron gets back Im sure he will have a much more in-depth, detailed description of the Markman than I just gave you....but...IMO...we have cleared the hurdle that needed to be cleared.
The Nokia news one has to assume was completed long before todays outcome of the markman hearing, but once again...with that in hand every single agreement from here on it should be for multiple years for multiple Millions.
Those who have sat on the sideline waiting for this will try to negotiate before any trial hits and any summary settlement issued byu the judge....PTSC needs to ask for MAX starting now and use this timing to hit the big contract dollars .JMHO
