Am I understanding correctly?. NEC and Toshiba have already requested USPTO to review the 336, and review has already been granted (when????). Unless that was just in the last few days, I would have expected them to ask the court for a stay. If they have not requested a stay, WHY? Makes no sense to me. Anyone have thoughts on WHY? Only thing I can think of is that negotiations may be close to an out-of-court settlement. Perhaps the PubPat request is ARM attempting to keep the ball rolling even if there are one or more settlements with the J3. Is that wishful thinking? And if there was a settlement with either NEC or Toshiba, can they pull their requests for patent review?
