With only three more days to go before we find out, many questions arise. IF they appeal, on what grounds? What cost? Laura Brown, in an excellent post, very clearly laid out what Cliffs are facing if they go the Appeal route. Would the Court accept their appeal and give the issue another hearing? We heard the cost alone to file any Appeal might be in the $50,000.00 range, plus if they again lose, paying all costs that KWG endures. The time factor is another big issue, we know Cliffs cannot wait the possible 5 year time span to resolve the Appeal, and even if they were to win, surely KWG would then appeal that ruling. In short, the whole Cliff's Agenda would surely be tied up for many, many years. Cliffs has a conference call set up for Oct. 25th to go over their quarterly results. How would they avoid analyst and shareholder questions about the way they have handled this infrastructure mess? And all they could report, would be, "we are appealling and stay tuned, we will advise you in 5 years or so, how it went". Good luck with that! I am certainly not a lawyer but wonder what would they gain by any kind of appeal if they have no way in h... of winning? Throwing good money after bad is surely no way for any public trading company to act.

Let us not forget the Federal and Provincial Governments, plus Aboriginal interests, all the Mayors in the surrounding areas, the ONTC, all have a big stake in this and they are all certainly hearing all the "clammering" to get on with this. Too much time has already been wasted by too many different people that no one will wait till Cliffs has another day in Court to try and overturn this very just decision by the Mining Commissioner. Make no mistake, we are certainly going to see some major movement regarding KWG in the not to distant future. In summing up, if Cliffs do decide to Appeal. do not be disheartened. I believe at the end of the day, David will once again slay Goliath. rj
