Got one question for you. Your post says: "Will Cliffs appeal or negotiate, or jointly appeal/negotiate?"
The first part is discussed in my post. Just wondering what you have in mind for the "jointly appeal" remark (jointly with whom?). Would CLF along with some others in the RoF (or elsewhere) make a strong case in an appeal? I thought, the Commission's decision is final and any appeal would have to be based on the Commission errors in its application of the law, or preferrential treatment of one party against the other, e.g. the Commission only looked at KWG arguments and unfairly dismissed evidence/argument presented by CLF. In fact, the Commission was pointing out its displeasure with CLF reluctance to provide evidence and the Commission had to ask, repeatedly, for it. Also the plan for building the private road for CLF did not go down too well with the Commission...and this is a crutial point in its decision (the Province was also criticized for not appearing to support CLF in its plan for this private road, which rumour says supported by the Province with matching fund).
Can an appeal (to a higher court) be based on a "change of plan"? e.g. CLF would say that it has now changed its mind and would make the road public? My simple mind says, this would be a no-go, since why didn't they say so in the first place (with the support from the Province) at the Commission hearing. Any legal mind in the house?
