It looks like the first vote would be very close, depending on which way PK swings the vote of those she controls.

Assuming Finiskiy can not vote his shares, the dissenters would win the day hands down.

And then there are the miriade of other options that the dissenters may have available to defeat the merger.

IMHO this merger will go down unless they improve the offer.

If the merger is not accepted there is no way that Finiskiy is going to let CMM fail because he has too much to lose if it does.

CMM is very close to commercial production and they are finding more gold all the time while they are doing the development work.

It will take a small injection of cash to get CMM to profitability, the sp will then rise and then Finiskiy can take his profits and run if he so choses.

Finiskiy will not let CMM fail.
