The key players probably would have some clout. But, with the company being scuttled, the shareholders are cooked because shareholders are very last in line for the spoils. Those key players of the scuttled company may become free agents or be uncooperative with Tenor. Not cooperating gets everybody nothing. The MIP will likely be a starting point for compensation for whichever key player chooses to cooperate with Tenor. Tough economy right now and having a job, any job, is a good thing. One thing we do not know for certain is if there are already under-the-table contingencies in place for such a scenario, and key players are already Tenorites should the "scorched earth" scenario become a reality. Speculating Tenor knows the game all too well.
But, man, that is only if a whole lotta "ifs" happen. Remember, company is negotiating with shareholder equity. Thinking the company will give up pretty much whatever to make it to arbitration and currently are just making it look good, like they are fighting for shareholders. Company wants to reach the arb. Notees would have to throw away 100 large, just in spite. Not sure Notees will. Money makes people do funny things and become cooperative, even with the worst of enemies.
