I will take a stab at it. The applicant or cry is submitting the plan with prejudice. I believe this means if denied it can no longer be submitted again on the same terms. If cry submits a plan I have to assume the noteholders are on board or it would be a pointless exercise as no where have I read the judge can force any plan on creditors. My belief was a 30 day extension would be granted and a plan of comprimise reached after leave to appeal is denied. On another note, a plan of reorg is to be submitted Oct 11 and cry submitted a similar plan Oct 11 of last year to stay alive.
