Noticed that Fung's Sept 7 affidavit, mentioned in the order, was suspiciously not attached. Leaving everyone to wonder the reasons given to be granted an extension. Might have to write OSB again, but not sure if an affidavit is mandated to be disclosed. Frankly surprised at the apathy here over lack of disclosure, when there is a Monitor and regulatory avenues provided to receive factual disclosure concerning the CCAA for Crystallex.

Guess this may blow the theory that Management/Bondies/Tenor do not have to negotiate and come up with a Plan of Compromise/Arrangement, as CCAA was designed. Speculating the, relatively short, 30 day Stay extension might indicate the court's patience has been tried a bit too long. One can only guess.

The, "with-prejudice," term... will let one of the several attorneys post about the meaning.
