After reading the case I would say you are correct. It seems like most of the problems that Murphy had Kry will not have.

I have said for a long time that I thought Kry was following the proper process. Many here have stated that Kry should have filed long ago, stopped building the hospitable and serer plant to save money. I don't like how long it has taken but VZ can't claim we didn't try to resolve this dispute and that we didn't follow the proper timeline or complete our obligations.

In my opinion Kry has positioned themselves in a very good position. It does make me wonder however how long Kry has known they would probably end up in court while telling us that they still expected the permit.

I suppose they may have had to take that position to bolster their case that they we acting in good faith during the process. Either way, assuming the financing gets resolved I see a win for Kry in court. I wouldn't still be here if I didn't.
