The whole system of arbitration, ICSID, trade agreements, etc. seems kind of useless in our situation.
If justice delayed is justice denied then we will not get much justice from the BIT.
Posting bonds sounds like a good idea. Just processing claims faster would help tremendously.
I really believe that Canada and the US should step up to the plate here. We are dealing with a country that clearly mixes politics and commerce and the only way to level the playing field is if we do the same. The BIT is useless if a company can be crushed by deliberate delays and political interference and the only solution I see is that our governments ensure that we can see the arbitration process through to the end. The cost to our governments would be minimal compared to the losses sustained by shareholders if VZ gets away with stiffing companies like ours.
I think Hugo figures that arbitration claims will never have to settled since in the new world order dominated by China, Russia, Iran, etc. North america and the world bank will be left impotent. I sure hope he's wrong.
