I say we NEVER go to arbitration.

Two outcomes are left (permit not being one of them).

1) Fung unsuccessful in raising enough bridge capital and we go bankrupt.

2) Fung raises enough capital to force Hugo to realize his waiting game is no longer viable and we get a decent settlement.

Our position vis a vis the MOC is unassailable but without sufficent bndge funds, meaningless.
