red, i know what you're saying (thats why i thought it was funny it went unnoticed)...

but it did sound like an offhand comment like "i think they have a clause about international arbitration in thier contract" not "krys f'd cause they gave up any legal recourse"...

in any case my belief (from board discussion, researching icsid and the bi-lateral treaty, kry statements, etc. etc) is that kry will (if litigation becomes necessary)......be able to pursue remedies outside of ven.....

i really think it will work out more like the cemex deal....kry claims $5bil in damages.. gets a few hundred $mil....
