I wouldn't think that an officer of a corporation would ever comment on possible litigation matters of another company.

For him to comment on a contract is ludicrous, therefore, I don't think he did.

Also, the comment is wrong to boot. In any contract, you must take the whole contract, not just one provision, standalone. I have been silent on this because most posts here are pretty much off when it comes to what Crystallex' options are in International court. Plus it is a bit premature to beat it to death right now.
