I see no reason for the 4 year clause to not be updated to present-day circumstances (with government and environmental regulations, size of mines being bigger etc.)

Our plan suggests a 5 year build date. No reason to not update it to a 5 year clause, or at worst a 6 year clause. I don't see why a judge would throw it out entirely and not modify it.

However, it's all a non-issue if Teck buys us out and it becomes void. It's only an issue if we sell to another major and at that point it's not a problem.

Realistically, although a bargaining chip - it doesn't add much in terms of dollars for us to sell, what it does do instead is create a sense of urgency for Teck to buy instead.
