As to the myth of naked shorts we've heard this about Overstock for the last 10 years or so and now go check on Overstock and it lawsuit coming up on against Merril Lynch. The naked short issue is far from dead and as stocks move up that is when the short issue comes into play and not when a stock is down. Cardio is far from dead and its heart is pumping like crazy!

OSTK) announced a California Court of Appeals decision has cleared the way for trial of its stock manipulation case against Merrill Professional Clearing Corporation, a clearing brokerage firm. In its long-standing suit, the company alleged defendants engaged in a naked short selling stock manipulation in an effort to drive down its share price. The company views Merrill Pro as one of the chief defendants in the case.
