Message: 2nd UPDATE: Ecuador's Assembly Revokes Mining Concessions

The Assembly, which is acting as the nation's legislature, passed the mining sector decree with 95 votes of its 130 members.

See, now this is where I have a problem: "acting as the nation's legislature"

On whose authority? President Correa's, correct? And how did he come by this authority? Previous constitution I should imagine. So, what does that document have to say about takings? Most Western Liberal Democracies (think back - Correa used those words to describe himself in an interview with El Comercio) have constitutions that protect private property against unlawful seizure, or expropriation without due compensation.

I'm just saying, if the constitution states this, and it isn't being respected, then there's no legal basis for rule by decree either. You can't pick and choose. The document is LAW in it's entirety. That's what makes it a constitution, and until it's repealed or amended it stands.

I'm not a lawyer, so someone correct me if I'm wrong, but isn't there a legal basis for removing, or at least curbing this so-called government? Not that it's going to happen of course, but should someone find the cajones, where exactly do they stand in terms of the law?

Just curious.
